{"id":24137,"date":"2026-10-08T18:05:34","date_gmt":"2026-10-08T18:05:34","guid":{"rendered":"https:\/\/catskillhousingauthority.com\/?p=24137"},"modified":"2026-10-08T19:40:35","modified_gmt":"2026-10-08T19:40:35","slug":"admissions-and-continued-occupancy-policy-acop","status":"publish","type":"post","link":"https:\/\/catskillhousingauthority.com\/?p=24137","title":{"rendered":"ADMISSIONS &amp; CONTINUED OCCUPANCY POLICY (ACOP) NOTICE OF PUBLIC COMMENT &amp; PUBLIC HEARING"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The <strong>Catskill Housing Authority (CHA)<\/strong> is announcing the start of a 45-day public notice and comment period for proposed updates to its <strong>Housing Admissions and Continued Occupancy Policy (ACOP)<\/strong>.\u00a0 The ACOP is a comprehensive, written document detailing federal rules and policies for managing the public housing program.\u00a0It ensures local agency operations align with federal laws and regulations set by the U.S. Department of Housing and Urban Development (HUD).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Residents and community members are encouraged to review the federal revisions and provide feedback before the policies are finalized.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The proposed updates incorporate current U.S. Department of Housing and Urban Development (HUD) admission requirements and guidance.&nbsp; Additionally, the revisions include NEW &nbsp; provisions of the Housing Opportunity Through Modernization Act of 2016 Sections 102 and 104 (HOTMA).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">HOTMA represents a significant update to federal housing program requirements. As a result, proposed revisions appear throughout the ACOP and address areas including new income calculations, asset limits, eligibility, verification standards and reexamination requirements. HUD will begin enforcing full compliance with Sections 102 and 104 of HOTMA for applicable public housing agencies beginning January 1, 2027.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In accordance with HUD requirements, CHA is providing a 45-day Public Notice period beginning November 6, 2026 and ending on December 21, 2026 to solicit comments from residents and the public on the proposed changes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A Public Hearing will be held on Wednesday, December 23, 2026 at 5:00pm at CHA\u2019s administrative office at 32 Bronson Street, Catskill, N.Y. 12414.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">CHA will accept written comments throughout the 45-day public comment period. Finally, the public housing lease will affect PHA policy and therefore must be consistent with federal and state laws and regulations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>HUD<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">HUD provides the primary source of PHA policy through federal regulations, HUD Notices and handbooks. Compliance with federal regulations, current HUD Notices and HUD handbooks is mandatory.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">HUD provides nonmandatory guidance to PHAs through HUD published guidebooks. Expired HUD Notices and handbooks also provide guidance for PHA policy.&nbsp; Following HUD guidance is optional, as long as PHA policies comply with federal law, federal regulations, and mandatory policy, and such HUD guidance has not been rescinded. Because HUD has already determined that the guidance it provides is consistent with mandatory policies, PHA reliance on HUD guidance provides the PHA with a \u201csafe harbor.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Material posted on the HUD website, HUD memos, HUD emails sent to executive directors, and responses to email inquiries directed to HUD can provide further clarification of HUD regulations and guidance. For example, FAQs on the HUD website can provide direction on the application of federal regulations to a specific pattern.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>State Law<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where there is no mandatory federal guidance, PHAs must comply with state law, if it exists. Where state law is more restrictive than federal law, but does not conflict with it, the PHA should follow the state law. For example, federal regulations establish the baseline for housing discrimination, accessibility, lead safety, and program funding, among many other things, while state laws may dictate specific landlord-tenant rules or local building and safety codes. Local ordinance may also come in to play and impact things like zoning, rental rules, and public safety. It is important to note that while fair housing is governed by the federal Fair Housing Act and other federal anti-discrimination laws (administered and enforced by HUD), there are often stricter state and local laws in many areas. Landlords and PHAs must follow whichever law is more restrictive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Industry Practice<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where no law or HUD authority exists on a particular subject, industry practice may support PHA policy.
